Lucas, who has been a Baw Baw Shire Councillor since 2020, was fined $4,000 and placed on an adjourned undertaking for 12 months after admitting to operating a category-one aquatic facility without registering it with the council.

The facility, which offered saunas and ice baths, was initially located in Warragul before being relocated to Drouin. Despite being issued a penalty infringement notice, Lucas failed to register the business with the council, sparking further investigation.

The Public Health and Wellbeing Act 2008 defines a category-one aquatic facility as a swimming pool, spa pool, or interactive water feature. Lucas’s business, Zen Den Warragul and later Zen Den Drouin, fell under this category, making registration with the council mandatory.

However, Lucas claims the oversight was ‘administrative’ and that he is ‘glad common sense prevailed’ in the end.

Magistrate Anthony Gywnne, however, was less than convinced, stating that ‘there are requirements that need to be followed’ and that Lucas’s actions demonstrated a ‘reckless disregard for public safety’.

The magistrate’s comments have sparked concerns about Lucas’s fitness for public office, particularly given his role as a councillor and now as a candidate for the upcoming Victorian election.
